1 )The applicant is reminded that there is a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 relating to the development the subject of this permission.
2 )You are reminded that the carrying out of building works requires approval under the building Regulations in many cases as well as a grant of planning permission. If you are in doubt as to whether or not the work, the subject of this planning permission, requires such approval, then you are invited to contact the Building Control Group of Babergh District Council at the Council Offices # general telephone number 01473-822801.
3 )The applicant is reminded that a public right of way crosses the site (Bridleway Pinewood 15) and nothing in this permission authorises its stopping up, diversion or obstruction (including during the construction period) and any such stopping up, diversion or obstruction must not be undertaken unless the necessary Orders have been confirmed under the relevant legislation.
4 )It is an offence to carry out works within the public highway, which includes a Public Right of Way, without the permission of the Highway Authority. Any conditions which involve work within the limits of the public highway do not give the applicant permission to carry them out. Unless otherwise agreed in writing all works within the public highway shall be carried out by the County Council or its agents at the applicant's expense. 5 )The Local Planning Authority recommends that developers of housing estates should enter into formal agreement with the Highway Authority under Section 38 of the Highways Act 1980 relating to the construction and subsequent adoption of Estate Roads.
6 )This development is within an area in which a cable television franchise operates. In this instance the cable company shall be treated as a statutory undertaker. It is essential that allowance be made for their apparatus and that any necessary cables are laid before surfacing is complete.
7 )The applicant's attention is drawn to the advisory comments set out in the Environment Agency's letter dated 06 December 2002 (copy attached).
